al-Mutli ala Daqaiq Zad al-Mustaqni «Fiqh al-Qada wa al-Shahadat» (The Illuminator on the Subtleties of Zad al-Mustaqni: Jurisprudence of Judiciary and Testimonies) is an extensive Hanbali legal commentary written by Abd al-Karim al-Lahim (d. 1438 AH / 2016–2017 CE) . The book expands upon the judicial and evidentiary sections of the classic legal manual Zad al-Mustaqni fi Ikhtisar al-Muqni by al-Hajjawi (d. 968 AH) .
Scope and Structure
The work is organized systematically into topics, chapters, and sub-sections, covering substantive judicial procedure and the law of evidence in Islamic jurisprudence:
- The Judiciary (Fiqh al-Qada): Designated as the ninth general subject of the broader series, this division examines the definition and legal status of judicial authority, appointment to judicial office, judicial arbitration (al-tahkim), the ethical conduct and decorum required of judges (adab al-qadi), the method and characteristics of issuing judicial rulings, the conveyance of letters between judges (kitab al-qadi ila al-qadi), the formal division of property (al-qisma), and the rules governing legal claims and judicial proof (al-da'awa wa-l-bayyinat) .
- Testimonies (Fiqh al-Shahadat): Designated as the tenth general subject, this section details the linguistic and technical definitions of testimony, its legal obligation, the qualifying conditions and disqualifying impediments for witnesses, the required number of witnesses across different legal categories, testimony upon testimony (al-shahada ala al-shahada), the legal effects of witnesses retracting their statements, and the administration of oaths in litigation .
In the multi-volume set, these sections are accompanied in the third volume by the eleventh subject covering the jurisprudence of dietary laws, ritual slaughter, hunting, sacrifices, oaths, and vows (Fiqh al-At'ima wa-l-Dhakah wa-l-Sayd wa-l-Dhabaih wa-l-Ayman wa-l-Nudhur) .
