al-Muʿtaṣar min Sharḥ Mukhtaṣar al-Uṣūl min ʿIlm al-Uṣūl (المعتصر من شرح مختصر الأصول من علم الأصول) is a contemporary work on Islamic legal theory (uṣūl al-fiqh) by the Egyptian scholar Abū al-Mundhir Maḥmūd ibn Muḥammad ibn Muṣṭafā ibn ʿAbd al-Laṭīf al-Minyāwī .
Background and Purpose
The book is an abridgment of al-Minyāwī's own commentary on an abridgment of Muḥammad ibn Ṣāliḥ al-ʿUthaymīn's foundational legal theory primer, al-Uṣūl min ʿIlm al-Uṣūl . After completing his detailed commentary, students requested a summarized version because the original commentary had become lengthy for beginners in the discipline . Al-Minyāwī authored the work to serve as a concise introduction and stepping stone for beginners before they study the larger commentary, as well as a link for students to study the principles of the Ḥanbalī school .
Methodology and Content
In composing the work, al-Minyāwī established several methodological principles:
- Confining the content to the topics addressed in the base text without adding new ones, while omitting complex peripheral discussions unsuitable for a primer—such as the question of what is immune to abrogation (mā yamtaniʿu naskhuh) due to its length and numerous ramifications .
- Limiting the discussion to core principles rather than sub-branches, and presenting the preponderant opinion (al-qawl al-rājiḥ) in definitions and theoretical matters without delving into scholarly disputes, except when addressing well-known opposing arguments was deemed necessary .
- Following the structural arrangement and topic headings of al-ʿUthaymīn's original manual, while permitting occasional additions, omissions, or adjustments to headings to ensure thematic coherence .
- Formulating definitions and legal preferences without strictly binding himself to al-ʿUthaymīn's exact phrasing .
- Stating and editing the positions of the Ḥanbalī school in most issues, while maintaining independence by adopting whichever position is supported by evidence (al-dalīl) rather than following a school unconditionally .
Publication
The author concluded the dedication of the text in Minya, Egypt, on 2 Dhū al-Qiʿdah 1431 AH (October 2010 CE), releasing its first edition that year . A second single-volume edition was issued in 1432 AH / 2011 CE through al-Maktaba al-Shāmila in Egypt .
