al-Muntaqa Sharh al-Muwatta (The Selected: Commentary on the Muwatta) is a legal commentary on the Muwatta of Malik ibn Anas, written by the Andalusian Maliki jurist and scholar Abu al-Walid al-Baji (403–474 AH / 1012–1081 CE) .

Origin and Purpose

Al-Baji initially authored an extensive, exhaustive commentary on the Muwatta titled al-Istifa' . In the introduction to al-Muntaqa, al-Baji stated that readers found al-Istifa' difficult to obtain and study, especially beginners who had not yet developed grounding in legal reasoning, as its vast number of cases and meanings could confuse rather than instruct those who were not already firmly rooted in knowledge . In response to requests for a more accessible text, he extracted and selected the core material from al-Istifa' to serve as a focused explanation of the legal meanings and derivations of the traditions in the Muwatta .

Method and Content

In al-Muntaqa, al-Baji followed the structure of the Muwatta, presenting each tradition or base ruling and following it with corresponding derivative legal questions (furūʿ) established by early authorities . His commentary emphasizes legal derivation (takhrīj), establishing the underlying principles (uṣūl) and legal maxims (qawāʿid) that govern each issue, while presenting different transmissions and perspectives from leading figures in the Maliki tradition .

The methodology of the book combines the dialectical and analytical reasoning of the Baghdadi jurists (ṭarīqat al-nuẓẓār) with the textual traditions of Andalusian and Qayrawani scholarship . Unlike hadith-focused commentaries, al-Baji deliberately refrained from citing chains of transmission (asānīd) and avoided exhaustive discussions of narrator criticism or the full arguments of opposing schools, dedicating the work primarily to comparative jurisprudence and independent legal assessment (ijtihād) supported by evidence . The work preserves numerous citations from early, otherwise lost Maliki sources, including the Mabsūṭ of Isma'il ibn Ishaq (al-Qadi Isma'il), the Thamāniya of Abu Zayd, and writings of Muhammad ibn Sahnun .

Abridgment, Scope, and Editions

Al-Baji later produced a further abridgment of al-Muntaqa titled al-Īmāʾ, structured in five volumes .

Biographers, including al-Qadi Iyad, al-Dhahabi, and Ibn Shakir al-Katbi, recorded al-Muntaqa as occupying twenty volumes in manuscript and praised it as an unmatched work in Maliki jurisprudence . The work was published in seven volumes in Cairo at Matba'at al-Sa'ada in 1331 AH (1913 CE), funded by Sultan Abd al-Hafiz and prepared under the supervision of Muhammad Mahmud ibn Shaqrun .
