al-Masail al-Muhimma fima Yahtaj Ilayh al-Aqid Inda al-Khutub al-Mudlahimma ("Important Issues Needed by the Contract Officiant during Dark Troubles") is a specialized treatise in Hanbali jurisprudence on the legal rulings of marriage contracts, authored by the Hanbali jurist and judge Shams al-Din Muhammad ibn Ahmad al-Maqdisi (771–855 AH / 1369–1451 CE) .
Subject and Sources
The work is dedicated to clarifying legal issues and knotty scenarios that arise during the conclusion of marriage contracts and their related provisions in Hanbali jurisprudence . In his introduction, al-Maqdisi states that he compiled the text primarily by extracting and selecting rulings from two foundational reference works by Ibn Qudama: al-Mughni and al-Kafi, supplemented by two sets of marginal notes (hashiyatayn) found on copies of al-Kafi .
Transmission and Attribution
The book is recorded in biographical and bibliographical dictionaries of the late Mamluk and Ottoman periods. It is cited as one of al-Maqdisi's works by al-Sakhawi in al-Daw' al-Lami', Mujir al-Din al-Ulaymi in al-Manhaj al-Ahmad, Ibn al-Imad al-Hanbali in Shadharat al-Dhahab, and Ibn Humayd in al-Suhub al-Wabila .
In contrast, the bibliographer Ismail Pasha al-Baghdadi attributed the work in both Idah al-Maknun and Hadiyyat al-Arifin to the Hanbali scholar and judge Izz al-Din Abd al-Aziz ibn Ali al-Maqdisi (d. 846 AH / 1442 CE) .
Manuscripts and Editions
A manuscript copy of the treatise is preserved in Dublin at the Chester Beatty Library within a composite volume (MS 3292), comprising 13 folios, transcribed by Ahmad ibn Muhammad al-Harrani and estimated to date from the ninth century AH . The treatise has been critically edited and published in modern academic scholarship .
