al-Kafil bi-Nayl al-Sul fi Ilm al-Usul (The Guarantor for Attaining the Request in the Science of Legal Theory) is a concise foundational manual on Islamic legal theory (usul al-fiqh) according to the Zaydi legal tradition, composed by the Yemeni scholar Muhammad ibn Yahya Bahran al-Zaydi (d. 957 AH / 1550 CE) .

Structure and Content

The treatise is structured into an introduction (muqaddimah), ten chapters (abwab), and a conclusion (khatimah) . In the opening preface, the author alludes to the book's title by characterizing the work as a concise manual on legal theory that guarantees (kafil) for whoever relies upon it the attainment of hopes and the ascent to scholarly perfection .

The first chapter is devoted to legal rulings and their classifications (al-ahkam wa-tawabi'uha), while the tenth chapter addresses the reconciliation and weighing of conflicting proofs (al-tarjih), and the conclusion covers definitions and technical terminology (al-hudud) . Within its substantive discussions, the work treats the primary sources of law—the Quran, the prophetic Sunnah, consensus (ijma'), and analogical reasoning (qiyas)—alongside epistemological questions . The manual incorporates distinctive Zaydi theoretical positions, including the non-reliance on solitary narrations (akhbar al-ahad) in foundational principles, the collective doctrinal authority and protection of the Prophet's household (Ahl al-Bayt), and the position that every qualified jurist (mujtahid) arrives at a correct ruling in practical speculative matters .

Versification and Commentaries

Al-Kafil became a standard pedagogical text and received several commentaries and versifications:

  • Versification: Muhammad ibn Ismail al-San'ani rendered the manual into verse in his didactic poem Bughyat al-Amil, praising al-Kafil as a refined, lucid, and rigorously edited summary . Al-San'ani's poem was later explained by Ismail ibn Muhammad ibn Ishaq al-Husayni (d. 1164 AH) in his commentary al-Fawasil Sharh Bughyat al-Amil fi Nazm al-Kafil .
  • Al-Kashif li-Dhawil-Uqul: A commentary titled al-Kashif li-Dhawil-Uqul an Wujuh Ma'ani al-Kafil bi-Nayl al-Su'ul by Ahmad ibn Muhammad Luqman (d. 1039 AH), edited by Dr. al-Murtada ibn Zayd al-Mahatwari al-Hasani, who also prepared an abridged commentary on the base text .
  • Al-Anwar al-Hadiyah: A commentary titled al-Anwar al-Hadiyah li-Dhawil-Uqul ila Ma'rifat Maqasid al-Kafil bi-Nayl al-Sul fi Ilm al-Usul by Ahmad ibn Yahya Habis al-Sa'di (d. 1061 AH) .

Modern Publication and Attribution History

A single-volume edition of the text was published by Dar Alam al-Fawa'id, edited by al-Walid ibn Abd al-Rahman Al Firyan under the title Mukhtasar fi Ilm Usul al-Fiqh, where it was erroneously attributed to the Hanbali scholar Abd Allah Aba Butayn (d. 1282 AH) based on Najdi manuscript copies . Subsequent research by Thamir Nasif and others established that the printed work was identical to Muhammad ibn Yahya Bahran's al-Kafil bi-Nayl al-Sul, demonstrating that its preface, phrasing, and doctrinal stances reflected Bahran's Zaydi manual rather than a Hanbali treatise .
