al-Jamʿ wa-al-Farq (Arabic: الجمع والفرق, lit. 'Gathering and Differentiating'), also widely known as al-Furūq (الفروق, 'Legal Distinctions'), is a classical work on Shafi'i jurisprudence by Abu Muhammad al-Juwayni (d. 438 AH / 1047 CE) that addresses legal distinctions between outwardly similar legal scenarios .

Title and Authorship

The author did not state the exact title in his introduction . Several surviving manuscript copies identify the work on their title pages and colophons as Kitāb al-Jamʿ wa-al-Farq . However, biographical dictionaries and classical jurists frequently referred to it under the functional title al-Furūq, reflecting its subject matter . Its attribution to Abu Muhammad Abd Allah ibn Yusuf al-Juwayni, the father of Imam al-Haramayn al-Juwayni, is unanimously accepted across biographical and legal sources .

Purpose and Scope

In his introduction, al-Juwayni explained that legal issues often resemble one another in form yet differ in their legal rulings due to underlying rationales (ʿilal) that necessitate distinct treatment . He noted that earlier scholars had compiled brief treatises on the topic, but their selections were limited to a small number of issues, prompting him to compose a far more comprehensive compendium .

The book is considered one of the most exhaustive classical works dedicated to the genre of legal distinctions, gathering more than 1,200 individual distinctions across all chapters of Islamic jurisprudence .

Structure and Method

Al-Juwayni opened the work with an introductory discussion defining the science of legal distinctions and categorizing the types of cases where distinctions arise . He followed this with a preliminary section presenting distinctions within legal theory (uṣūl al-fiqh) before moving to substantive jurisprudence (furūʿ) .

The substantive legal material is organized according to the thematic sequence of Mukhtaṣar al-Muzanī by al-Muzani, beginning with the Book of Purification (Kitāb al-Ṭahāra) and the Book of Prayer (Kitāb al-Ṣalāt), and progressing through the remaining legal topics .

In each entry, al-Juwayni presents two cases that share an apparent resemblance in scenario but carry divergent rulings, subsequently articulating the distinguishing rationale between them . The differentiating basis may rest on an explicit text from the Quran or Sunnah, or on analytical legal causes; he occasionally provides up to three distinct justifications for a single differentiation or derives a general legal maxim (qāʿida) from the discussion . He also employs hypothetical questions (such as "if it is said... then the answer is...") to structure his arguments .

Throughout the text, al-Juwayni cites the transmitted opinions of al-Shafi'i, identifying their transmitters—such as al-Rabi ibn Sulayman and al-Muzani—and specifying whether an opinion belonged to al-Shafi'i's earlier (qadīm) or later (jadīd) school . He also assesses transmission discrepancies, occasionally critiques al-Muzani's narrations, reviews intra-school variants (wujūh and ṭuruq), and states his own preferred determinations .

Reception and Influence

The work holds a prominent place in the literature of Shafi'i legal maxims and distinctions:

  • Badr al-Din al-Zarkashi described it as among the finest works composed on the subject of al-jamʿ wa-al-farq .
  • Jamal al-Din al-Isnawi characterized it as a large, immensely beneficial volume .
  • Najm al-Din al-Tufi wrote that it was the largest work he had encountered in the genre of furūq, containing the greatest number of issues, the soundest legal foundations, and the most subtle analytical derivations .
  • Al-Nawawi drew heavily upon it in al-Majmūʿ, citing it more than twenty-one times in the chapter on purification alone under the title al-Furūq .
  • Jalal al-Din al-Suyuti also cited it in his legal maxim compendium al-Ashbāh wa-al-Naẓāʾir .

Editions

A complete academic edition of the work, edited and studied by Abd al-Rahman ibn Salamah al-Muzayni based on multiple manuscripts, was published in Beirut by Dar al-Jeel in 1424 AH / 2004 CE .
