al-Istilam (al-Istilām fī al-Khilāf bayn al-Imāmayn al-Shāfiʿī wa-Abī Ḥanīfah) is a work on comparative Islamic jurisprudence (khilāf) authored by the Shafi'i jurist Abu al-Muzaffar al-Sam'ani (426–489 AH / 1035–1096 CE) . The book focuses on the substantive differences in legal rulings between al-Shafi'i and Abu Hanifa .
Background and Purpose
Abu al-Muzaffar al-Sam'ani was raised in a prominent Hanafi scholarly household in Merv and taught and debated within the Hanafi school for three decades before converting to the Shafi'i madhhab during his travels to the Hijaz in the 460s AH . Following his shift to the Shafi'i school, al-Sam'ani composed al-Istilam—also referred to as an abridgment (al-Mukhtaṣar)—primarily as a detailed refutation of the prominent Hanafi jurist Abu Zayd al-Dabbusi (d. 430 AH) and as a response to the legal problems and underlying rationales collected in al-Dabbusi's work al-Asrār .
Structure and Content
The work opens with a supplication in its sermon: "O God, make my breast a treasury of Your divine oneness, my tongue a key to Your glorification, and my limbs servants of Your obedience..." .
al-Istilam systematically covers the standard branches of Islamic law, setting out Shafi'i legal opinions, arguments, and counter-arguments against Hanafi doctrines . Its chapters include:
- Acts of Worship (ʿIbādāt): comprising purification, prayer, zakat, fasting, and the pilgrimage (hajj) .
- Transactions (Muʿāmalāt): beginning with commercial sales (buyūʿ), usury (ribā), and contract validity .
In the section on usury, al-Sam'ani highlighted the technical rigor of comparative legal reasoning, remarking that jurisprudence is exacting and only yields to those supported by insight, sound creed, and divine assistance .
Reception and Editions
The author's grandson, the historian Abu Sa'd al-Sam'ani, recorded that al-Istilam achieved wide circulation and prominence across different regions . Later biographers and jurists, including Taj al-Din al-Subki, frequently cited and discussed its legal analyses and preferred stances on disputed questions .
In modern times, the work has been edited and published under the scholarship of Nayif ibn Nafi' al-Umari .
