al-Insaf fi Marifat al-Rajih min al-Khilaf (Equity in Determining the Preponderant View Among Disputed Opinions) is a comprehensive reference work of Hanbali jurisprudence by the Syrian jurist Ala al-Din al-Mardawi (d. 885 AH / 1480 CE) . The book serves as an exhaustive critical apparatus and commentary on al-Muqni by Ibn Qudamah (d. 620 AH / 1223 CE), written to determine the sound (al-sahih), well-known (al-mashhur), and relied-upon positions of the Hanbali school from among competing transmissions and internal differences .

Background and Composition

Al-Mardawi noted in his introduction that although al-Muqni was widely studied, Ibn Qudamah frequently cited differing narrations (riwayāt), variants (awjuh), and interpretations without specifying which one represented the standard school doctrine, leaving readers uncertain about what was weak or sound . Al-Mardawi composed al-Insaf to resolve these unresolved disputes (al-khilaf al-mutlaq), correct misattributed rulings, supply missing conditions and qualifications, and clarify ambiguous legal statements .

He completed the composition of the work at the end of Rabi al-Thani 867 AH . That same year, he traveled to Cairo and presented the text to the Hanbali Chief Judge Izz al-Din al-Kinani, who commended the work and instructed Hanbali scholars in Egypt to transcribe and circulate it .

Structure and Methodology

In manuscript form, al-Insaf was arranged across four large volumes following the standard chapter structure of al-Muqni . Al-Mardawi's method entails citing each legal issue from al-Muqni, followed by an exhaustive breakdown of the reported views within the madhhab, citing each opinion back to the original Hanbali works and authorities from which it was transmitted . He then determines the authoritative position by using formulas such as "this is the school's doctrine" (huwa al-madhhab) or "this is what the majority of the authorities hold" (alayhi jamahir al-ashab) .

To determine the preponderant position when later authorities disagreed, al-Mardawi established specific textual weightings in his preface:

  • Reliance was placed on the formulations of major refining scholars, such as Ibn Qudamah (particularly in al-Kafi), Majd al-Din Ibn Taymiyyah, Abd al-Rahman ibn Abi Umar (in al-Sharh al-Kabir), Ibn Muflih (in al-Furu), Ibn Razin (in al-Wajiz), Taqi al-Din Ibn Taymiyyah, and Ibn Abdus (in his Tadhkirah) .
  • If these authorities differed, the doctrine was generally taken to be what Ibn Muflih gave precedence to (qaddama) in al-Furu .
  • If Ibn Muflih left the disagreement open, the relied-upon position was taken from the agreement of Ibn Qudamah and Majd al-Din Ibn Taymiyyah .

Throughout the book, al-Mardawi appended extensive supplementary notes titled fa'idah (benefit), which outlined exclusive Hanbali legal positions (mufradat), intricate cases (al-alghaz), and the practical legal ramifications of disagreements .

Reception and Influence

al-Insaf was acclaimed by subsequent Hanbali scholars as a landmark text for the verification (tashih) and systematization of the school . The historian Mujir al-Din al-Ulaymi (d. 928 AH / 1522 CE) praised it as unprecedented in establishing the sound views of the madhhab and as evidence of the author's extensive erudition and breadth of reading . Ibn al-Imad al-Hanbali likewise described it as one of the great books of Islam .

The determinations in al-Insaf became the basis for later authoritative Hanbali manuals that aimed to present a single relied-upon ruling for each issue, including al-Iqna by Musa al-Hajjawi, Muntaha al-Iradat by Ibn al-Najjar al-Futuhi, Ghayat al-Muntaha by Mar'i al-Karmi, and Dalil al-Talib .

Abridgments

Several scholars produced abridgments of the work:

  • al-Tanqih al-Mushbi fi Tahrir Ahkam al-Muqni, prepared by al-Mardawi himself as a concise one-volume summary of al-Insaf, completed in Shawwal 872 AH .
  • al-Ithaf bi-Ikhtisar al-Insaf, an abridgment by Mujir al-Din al-Ulaymi .
  • An abridgment by Muhammad ibn Abd al-Wahhab (d. 1206 AH / 1792 CE), which combined selected material from al-Sharh al-Kabir and al-Insaf into a single text .

Printed Editions

al-Insaf was first published in 12 volumes in Cairo by Maktabat al-Sunnah al-Muhammadiyyah (1375 AH / 1956 CE), edited by Muhammad Hamid al-Fiqi . A later edition was published in Cairo by Dar Hajar (1414 AH / 1993 CE), edited by Abd Allah ibn Abd al-Muhsin al-Turki and Abd al-Fattah Muhammad al-Hulw, printed jointly with al-Muqni and al-Sharh al-Kabir in 32 volumes including indices .
