al-Insaf fi Hukm al-I'tikaf (Fairness Regarding the Legal Ruling of Spiritual Retreat) is a Hanafi legal treatise written by the Indian scholar Abu al-Hasanat al-Lakhnawi (1264–1304 AH / 1848–1886 CE) examining the precise juristic rulings governing i'tikaf (spiritual retreat in the mosque) .
Background and Composition
The impetus for writing the treatise was a scholarly debate that occurred in 1282 AH in Hyderabad, Deccan, between al-Lakhnawi—then eighteen years old, having recently returned from his first pilgrimage to Mecca and Medina and engaged in study under his father—and another scholar . The dispute centered on whether i'tikaf is an emphasized communal sunnah (sunna mu'akkada 'ala al-kifaya) or an individual obligation ('ala al-'ayn), and if communal, whether it applies to the entire town or to each individual neighborhood . Because both parties had spoken spontaneously from memory without consulting authoritative references, al-Lakhnawi undertook a thorough examination of authoritative legal texts . He completed the work on 9 Ramadan 1284 AH at the age of twenty .
Contents and Legal Inquiries
The work investigates the legal ruling of retreat across six distinct stations (maqamat) :
- Whether i'tikaf is recommended (mustahabb), a sunnah, permissible (mubah), or obligatory (wajib) .
- Whether it is an emphasized sunnah (sunna mu'akkada) or non-emphasized (ghayr mu'akkada) .
- Whether it constitutes an emphasized sunnah of communal or individual obligation .
- Whether the communal requirement rests on the residents of an entire locality or upon each neighborhood .
- Whether it is an emphasized sunnah unconditionally or specifically in Ramadan .
- Whether the sunnah necessitates encompassing the entirety of the last ten days of Ramadan or merely a portion of them .
Al-Lakhnawi drew upon more than twenty Hanafi legal references to assess these issues . He reconciled classical statements, including Abu al-Husayn al-Quduri's characterization of i'tikaf as recommended, by explaining that it is recommended in its general essence whereas observing it during the final ten days of Ramadan is a sunnah . He also rejected the view that the Prophet's regular observance implied strict obligation, noting that the absence of reprimand toward companions who omitted it indicated sunnah status . He concluded that i'tikaf is inherently recommended, becomes obligatory only if vowed, and is an emphasized communal sunnah when observed across the entire final ten days of Ramadan .
Commentary and Publication History
During al-Lakhnawi's lifetime, his student Muhammad 'Abd al-Ghafur al-Ramdanfuri composed a supercommentary on the text titled al-Is'af bi-Tahshiyat al-Insaf, completing it in Rabi' al-Awwal 1302 AH . Al-Ramdanfuri frequently referenced al-Lakhnawi's other legal and biographical works, as well as Ibn Hajar al-Asqalani's Fath al-Bari .
The text was first printed in Lucknow in 1303 AH and reprinted there in 1337 AH . A modern critical edition, edited by Majd ibn Ahmad Makki alongside al-Ramdanfuri's commentary, was published in Beirut by Dar al-Basha'ir al-Islamiyyah in 1420 AH / 1999 CE .
