al-Inṣāf fī al-Tanbīh ʿalā al-Asbāb allatī Awjabat al-Ikhtilāf bayn al-Muslimīn (Equity in Clarifying the Causes That Necessitated Disagreement Among Muslims) is a treatise on legal theory, linguistics, and the sources of scholarly dispute by the Andalusian philologist and scholar Ibn al-Sayyid al-Batalyawsi (444–521 AH / 1052–1127 CE) . The book examines the linguistic, methodological, and evidentiary foundations behind theological and jurisprudential divergences among Muslim scholars .

Title and Transmission

Biographical and bibliographical sources record the work under several variant titles:

  • In Ibn Khallikan's Wafayāt al-Aʿyān, Ibn Bashkuwal's al-Ṣilah, Ibn al-ʿImad's Shadharāt al-Dhahab, and Ibn Farhun's al-Dībāj al-Mudhahhab, it is cited as al-Tanbīh ʿalā al-Asbāb al-Mūjibah li-Ikhtilāf al-Ummah (or al-Khalaf) .
  • In Ibn Khayr al-Ishbili's Fahrasah, the title is given as Kitāb al-Tanbīh ʿalā al-Asbāb allatī Awjabat al-Khilāf bayn al-Muslimīn fī ʿAqāʾidihim wa-Madhāhibihim, maʿa al-Kalām fī al-Ism wa-l-Musammā . Ibn Khayr recorded hearing the work directly from Ibn al-Sayyid's disciple, Abu Muhammad 'Abd Allah ibn Ahmad ibn Sa'id al-'Abdari (known as Ibn Mawjawāl al-Balansī) .
  • Al-Maqqari noted it in Azhār al-Riyāḍ as al-Tanbīh ʿalā al-Asbāb allatī Awjabat al-Ikhtilāf bayn al-Muslimīn fī Raʾyihim wa-Iʿtiqādihim .
  • Al-Fath ibn Khaqan cited it as al-Tanbīh ʿalā al-Sabab al-Mūjib li-Ikhtilāf al-ʿUlamāʾ fī Iʿtiqādātihim wa-Ārāʾihim wa-Sāʾir Aghrāḍihim wa-Anḥāʾihim, while Jalal al-Din al-Suyuti referred to it as Sabab Ikhtilāf al-Fuqahāʾ, and Hajji Khalifa recorded it in Kashf al-Ẓunūn as al-Tanbīh ʿalā al-Asbāb al-Mūjibah li-l-Khilāf bayn al-Muslimīn .

Scope and Method

Ibn al-Sayyid approached the phenomenon of scholarly difference through a systematic linguistic and legal-theoretical framework . In the prologue, he posits that human intellectual divergence is an inherent part of creation reflecting divine wisdom, citing Qur'anic verses on diversity, and argues that while objective truth remains unified, the avenues, hermeneutical tools, and analogical methods leading to it inevitably vary .

Ibn al-Sayyid categorizes the causes of disagreement among the mainstream community into eight primary sources :

  1. Linguistic and conceptual homonymy (Ishtirāk al-alfāẓ wa-l-maʿānī): Ambiguity arising in the root meaning of isolated words, their morphological variations, or their syntactic combination .
  2. Literal versus figurative meaning (al-Ḥaqīqah wa-l-majāz): Hesitation between literal expressions and tropes in single words, inflections, or compound sentences .
  3. Singularity and composition / independent legal efficacy (al-Ifrād wa-l-tarkīb / Istiqlāl al-dalīl bi-l-ḥukm wa-ʿadamuhu): Whether an evidentiary indicator functions independently or requires contextual composition .
  4. Generality versus particularity (al-Khuṣūṣ wa-l-ʿumūm): Differences concerning whether an address applies broadly or is restricted to specific circumstances .
  5. Hadith transmission and narration (al-Riwāyah wa-l-naql): Disagreements arising from variant textual transmissions, chains of transmission, and eight underlying evidentiary defects .
  6. Juristic reasoning and analogy (al-Ijtihād wa-l-qiyās): Discrepancies occurring in matters where no explicit, decisive scriptural text exists .
  7. Abrogation (al-Nāsikh wa-l-mansūkh): Claims and disputes regarding whether a legal text remained operative or was superseded .
  8. Permissibility and broad accommodation (al-Ibāḥah wa-l-tawassuʿ): The arrival of texts bearing multiple permissible applications and broad legal latitude .

Reception and Influence

The work is considered one of the earliest dedicated and comprehensive treatises on the theoretical causes of divergence among Muslim jurists and theologians . Al-Maqqari characterized it as "a magnificent book, the like of which has not been authored" .

Later legal theorists drew directly on Ibn al-Sayyid's scheme; notably, Abu Ishaq al-Shatibi incorporated his eightfold classification into al-Muwāfaqāt fī Uṣūl al-Sharīʿah, acknowledging Ibn al-Sayyid's precedence in classifying these causes . The book is also utilized in Qur'anic exegesis (tafsīr) methodology, as it applies its analytical categories to explain why early exegetical authorities diverged over the interpretation of specific verses .
