al-Furuq (Arabic: الفروق, lit. 'Legal Distinctions') is a specialized treatise on Hanbali jurisprudence by the jurist and magistrate Ibn Sunayna al-Samiri (535–616 AH / 1140–1219 CE) . The work is dedicated to clarifying subtle differences in legal rulings between legal cases that appear identical or similar in outward form, elucidating their textual proofs, rationales, and underlying principles .

Purpose and Structure

Ibn Sunayna composed the book in response to persistent requests from students and associates who urged him to compile a work outlining legal distinctions . Its primary objective is to articulate the evidentiary bases (ma'akhidh) and causes ('ilal) of divergent legal rulings, ensuring that jurists apply analogical deduction (qiyas) accurately and avoid building legal determinations on false resemblances .

The treatise is organized according to the standard thematic sequence of Hanbali legal manuals, commencing with the section on acts of worship (qism al-'ibadat)—beginning with ritual purity (tahara)—followed by commercial and civil transactions (mu'amalat) . Within individual discussions, cross-chapter comparative examples are frequently introduced; an issue pertaining to fasting may be analyzed within the chapter on ritual purity, or a branch concerning prayer and pilgrimage within the chapter on fasting, depending on the analytical requirements of the legal comparison .

Reception and Abridgments

al-Furuq earned praise among Hanbali scholars as a foundational manual in its genre. The jurist al-Tufi described it as one of the finest books of legal distinctions, noting its abundance of legal cases, utility, and subtle, precise derivations . Ibn Rajab observed that al-Samiri incorporated significant benefits and rare legal scenarios across al-Furuq and his broader compendium al-Mustaw'ib , and Ibn Badran similarly characterized it as an exceptionally beneficial work .

The Baghdadi Hanbali scholar Sharaf al-Din 'Abd al-Rahim ibn 'Abdullah al-Zurayrani (d. 741 AH) abridged and revised the text in a work titled Idah al-Dala'il fi al-Farq bayn al-Masa'il (also known as Tanqih al-Furuq) . In this abridgment, al-Zurayrani condensed al-Samiri's prose, added further distinctions and critical comments, and attributed prophetic traditions to standard hadith collections .

Publication

The section covering acts of worship (Volume 1) was edited by Muhammad ibn Ibrahim al-Yahyā as a master's thesis at Imam Mohammad Ibn Saud Islamic University and published by Dar al-Sumay'i in Riyadh in 1418 AH (1997 CE) .
