al-Furuq al-Fiqhiyya wal-Usuliyya: Muqawwimatuha, Shurutuha, Nash'atuha, Tatawwuruha (Jurisprudential and Legal Theoretical Distinctions: Their Components, Conditions, Origin, and Development) is a specialized treatise on Islamic legal methodology by Yaqoub al-Bahisin (d. 1443 AH / 2022 CE) . It provides a theoretical, descriptive, and historical foundation for the science of legal distinctions ('ilm al-furuq) in both substantive jurisprudence (fiqh) and legal theory (usul al-fiqh) .
Background and Purpose
The material for the book developed out of al-Bahisin's experience teaching legal maxims (al-qawa'id al-fiqhiyya) to postgraduate students at the Faculty of Sharia at Imam Mohammad Ibn Saud Islamic University in Riyadh over many years . Al-Bahisin observed that classical authors primarily produced applied compilations listing differences between individual legal cases across traditional legal chapters, without establishing the theoretical frameworks, boundaries, definitions, origins, and conditions of furuq as an independent discipline . He composed the work to supply this theoretical groundwork, structuring it into two main chapters: one dedicated to distinctions in substantive law and the other to distinctions in legal theory .
Contents and Structure
The book opens with a general introduction detailing the importance of distinctions across disciplines, followed by two core chapters :
- Chapter One: The Science of Jurisprudential Distinctions ('Ilm al-Furuq al-Fiqhiyya): Begins with a preliminary overview addressing the linguistic and technical definitions of furuq, its subject matter, issues, benefits, sources of derivation, and legal ruling . It proceeds to categorize legal distinctions (such as distinguishing between a base case and a novel case in legal analogy), explores its early emergence and development in Quranic verses and prophetic traditions, and surveys classical and contemporary writings in the genre across the Sunni legal schools .
- Chapter Two: The Science of Principles-Based Distinctions ('Ilm al-Furuq al-Usuliyya): Offers a preliminary section on defining the field, its parameters, utility, and sources . It investigates types of distinctions between theoretical principles, including defining terms and conceptual boundaries (such as cause, condition, and hindrance) and examining differing legal implications . It traces the historical progression of usuli distinctions alongside the development of legal dialectics (jadal) and analyzes specialized works touching on the subject, evaluating works such as al-Qarafi's al-Furuq .
Publication
The work was published in a single volume by Maktabat al-Rushd in Riyadh, with its first edition appearing in 1419 AH / 1998 CE .
