al-Fawaid al-Mukhasasa bi-Ahkam Kay al-Hamsa (Arabic: الفوائد المخصصة بأحكام كي الحمصة, lit. 'The Designated Benefits Concerning the Rulings of Chickpea Cauterization') is a legal treatise on Hanafi ritual purity by the Syrian jurist Ibn Abidin (d. 1252 AH / 1836 CE) . It examines the legal status of bodily fluids drawn by the medical application of a chickpea over a cauterized incision, specifically regarding ritual purity (taharah), the nullification of ablution (naqd al-wudu), and the validity of prayer .

Background and Composition

Ibn Abidin composed the treatise to resolve common doubts surrounding a surgical technique invented by contemporary physicians, in which a chickpea is placed over a cauterized incision under a leaf and bandage to absorb and draw out bodily humors . Because the practice had become widespread, questions frequently arose concerning whether the moisture absorbed by the dressing invalidated a patient's ablution or rendered their garments impure .

In the introduction, Ibn Abidin states that he drew upon two earlier treatises addressing the subject: one by the Egyptian Hanafi jurist Hasan al-Shurunbulali (d. 1069 AH / 1659 CE) and another by the Damascene scholar Abd al-Ghani al-Nabulusi (d. 1143 AH / 1731 CE), titled al-Maqasid al-Mumahhasa fi Bayan Kay al-Himmasa . He also later consulted a second holographic treatise by al-Nabulusi entitled al-Abhath al-Mukhlisa fi Hukm Kay al-Himmasa . Ibn Abidin completed the drafting of his work at the end of Jumada al-Ula 1227 AH (May/June 1812 CE) .

Structure and Legal Content

The treatise is structured into nine preliminary legal principles (fawaid) followed by an applied analysis of the cautery procedure and a critical evaluation of earlier rulings :

  • Preliminary legal principles: Ibn Abidin synthesizes foundational Hanafi doctrines regarding the flow (sayalan) of blood, pus, and serous fluids from non-private orifices . He details that bodily discharges from places other than the two private passages only invalidate ablution if they actively flow to an area requiring ritual cleansing, distinguishes between natural flowing and extracted discharges, and explains the concept of "potential flow" (sayalan bi-al-quwwah), where fluid repeatedly wiped or absorbed is assessed according to whether it would have flowed if left unattended .
  • Rulings on chickpea cauterization: The work divides the surgical situation into two main legal categories :
    1. Non-flowing moisture: If the discharge is merely oozing moisture (rashh) drawn out by the chickpea and leaf without possessing the inherent capacity to flow on its own, it is legally pure (tahir). It does not break ablution, does not defile clothing even if extensive, and does not require changing the dressing before prayer .
    2. Flowing fluid: If the fluid possesses the force to flow by itself, it is impure (najis) and nullifies ablution . In this scenario, the individual cannot claim the status of an excused person (sahib udhr) if the discharge can be halted simply by removing the chickpea, though they remain excused if the wound continues to flow uncontrollably on its own .
  • Critique and dispensation: Ibn Abidin analyzes al-Shurunbulali's positions approvingly while critiquing al-Nabulusi's premise that a bandage over the cautery shares the legal status of the wound itself . To alleviate severe hardship, he cites an alternative position from Burhan al-Din al-Marghinani's Mukhtarat al-Nawazil, noting that those afflicted may adopt the view that fluids seeping out little by little without immediate flow do not invalidate ablution .

Transmission and Editions

Ibn Abidin cross-referenced the legal investigations established in this treatise in his major legal commentary Radd al-Muhtar ala al-Durr al-Mukhtar . The work was published as part of his collected legal treatises (Majmuat Rasail Ibn Abidin), with early printings issued in Damascus in 1301 AH (1883/1884 CE) and Istanbul in 1325 AH (1907/1908 CE) .
