al-Faiq fi Usul al-Fiqh (The Excelling Treatise on the Principles of Islamic Jurisprudence) is a work on legal theory (usul al-fiqh) by the Shafi'i jurist and theologian al-Safi al-Hindi (644–715 AH / 1246–1315 CE) .
Composition and Purpose
The author composed the work as a condensed abridgment (mukhtasar) of his own comprehensive, multi-volume manual on legal theory, Nihayat al-Wusul fi Dirayat al-Usul . In his preface, al-Safi al-Hindi stated that his larger work had become extensive, detailed, and difficult for intermediate students to master and retain . He therefore sought to create an accessible text that would be easy to memorize and consult, while retaining the essential legal issues, analytical discussions, proofs, questions, and rebuttals of the original work .
He titled the book al-Faiq because he intended it to surpass other abridgments in the discipline in its density of benefits and precise legal insights, maintaining a moderate concision between excessive length and deficiency . While some biographical sources mention al-Faiq as an alternate title for his larger work al-Nihaya or record a theological book by him under a similar title, manuscript records and the author's own introduction identify al-Faiq fi Usul al-Fiqh as his distinct legal theory abridgment .
Method and Reception
The book follows the analytical method of the dialectical theologians (tariqat al-mutakallimin) in Shafi'i legal theory . Al-Safi al-Hindi's formulations of legal theory were extensively utilized by later scholars, most notably Taj al-Din al-Subki, who drew heavily upon al-Safi al-Hindi's treatises in his legal commentary al-Ibhaj fi Sharh al-Minhaj, frequently incorporating his phrasing and arguments .
Manuscripts and Editions
Manuscripts of the work are preserved in several collections, including the Khedivial Library in Cairo, the al-Abdaliyya Library at al-Zaytuna Mosque in Tunis, and the Islamic University of Madinah .
The text has been published in modern scholarly editions, including an edition prepared by Ali al-Umayrini (1411 AH / 1991 CE) and an edition edited by Mahmud Nassar (Beirut: Dar al-Kutub al-Ilmiyya, 2005 CE) .
