al-Burhan fi Usul al-Fiqh (The Proof in Legal Theory) is a treatise on Islamic jurisprudence authored by the Shafi'i jurist and Ash'ari theologian Abu al-Ma'ali al-Juwayni (419–478 AH / 1028–1085 CE), known as Imam al-Haramayn . Written according to the method of the speculative theologians (tariqat al-mutakallimin), it is regarded as one of the foundational pillars of the discipline alongside works such as al-Umad by al-Qadi Abd al-Jabbar and al-Mu'tamad by Abu al-Husayn al-Basri .
Method and Structure
Al-Juwayni organized al-Burhan around extensive preliminary epistemological and theological inquiries before turning to the derivation of legal rulings . The introductory sections define legal theory, its sources, and its objectives; address the nature of legal rulings (ahkam); critique Mu'tazili doctrines on rational good and evil (al-tahsin wa-l-taqbih) and the obligation of gratitude to the Benefactor (shukr al-mun'im); and expound upon rational inquiry (al-nazar), legal accountability (al-taklif), and the avenues of rational cognition (madarik al-uqul) .
The core legal-theoretical material is divided into several main sections:
- Clarification (al-Bayan): Covers the scriptural sources (the Quran and Sunna), including commands and prohibitions, the absolute and qualified, general and specific expressions, the legal authority of the Prophet's ﷺ actions, modes of textual interpretation (ta'wil), transmitted reports (al-akhbar), the conditions of mass-transmitted (mutawatir) and solitary (ahad) reports, narrators, and the rules of disparagement and accreditation (al-jarh wa-l-ta'dil) .
- Consensus (al-Ijma'): Details the nature, authority, and conditions of scholarly consensus .
- Analogy (al-Qiyas): Examines analogical reasoning, legal ratio ('ilal), and the division of underlying objectives (maqasid) and public interests (masalih), including necessities and general needs .
- Juridical Evidence (al-Istidlal): Discusses non-analogical derivation methods, addressing juristic preference (al-istihsan) and unmentioned public interests (al-masalih al-mursala) .
- Abrogation (al-Naskh): Concludes with the rules and conditions governing scriptural abrogation .
The book is also notable for preserving the legal-theoretical positions of earlier authorities whose original writings have been lost, such as Abu Bakr al-Baqillani, Ibn Furak, Abu al-Hasan al-Ash'ari, al-Sayrafi, and al-Daqqaq .
Scholarly Style and Reception
al-Burhan is characterized by its rigorous, dense language and independent analytical methodology . Taj al-Din al-Subki noted that al-Juwayni crafted the work in an unprecedented style, dubbing it Lughz al-Ummah ("the riddle of the community") because of the complexity of its inquiries and the author's insistence on independent conclusions (ikhtiyarat) that did not strictly conform to either Shafi'i legal positions or Ash'ari theological precedents .
Despite al-Juwayni's affiliation with the Shafi'i school, early Shafi'i scholars generally did not author comprehensive commentaries on the text, with only limited critiques such as those by Abu al-Muzaffar al-Sam'ani in Qawati' al-Adillah . Instead, the book attracted extensive commentary, engagement, and abridgment primarily from Maliki scholars of the Islamic West and Egypt . Al-Subki attributed this Maliki interest partly to their desire to defend al-Ash'ari's formulations against al-Juwayni's divergences, as well as their response to al-Juwayni's critical stances toward Malik ibn Anas, particularly on the question of al-masalih al-mursala .
Commentaries and Abridgments
Numerous scholars produced commentaries, glosses, and abridgments based on al-Burhan:
- Idah al-Mahsul min Burhan al-Usul (an incomplete commentary) and a companion work on its complex passages (Mushkilat al-Burhan) by the Maliki jurist Abu Abd Allah al-Mazari (d. 536 AH) .
- al-Tahqiq wa-l-Bayan fi Sharh al-Burhan by Abu al-Hasan al-Abyari (d. 618 AH), which provides a complete commentary on the work .
- Kifayat Talib Ilm al-Bayan fi Sharh al-Burhan by Abu Yahya Zakariyya al-Sharif al-Maghribi (fl. 629 AH), who synthesized the commentaries of al-Mazari and al-Abyari .
- al-Kafil bi-l-Wusul ila Thamarat al-Usul, an abridgment and refinement by Ibn al-Munayyir (d. 683 AH), who also authored a commentary on the work .
- al-Mankhul min Ta'aliq al-Usul by al-Juwayni's student Abu Hamid al-Ghazali (d. 505 AH), which extracted and summarized the subject matter of his teacher's legal-theoretical notes .
- Additional works include al-Nukat by Taqi al-Din al-Muqtarah (d. 612 AH), an abridgment by Ibn Ata Allah al-Iskandari, and Nazir al-Ayn fi Mukhtasar al-Burhan by Atiq ibn Ahmad al-Farra al-Wadi Ashi (d. 696 AH) .
Modern Publication
The text was edited from manuscript copies by Abd al-Azim al-Dib and published in Qatar in 1399 AH (1979 CE) under the auspices of the Department for the Revival of Islamic Heritage . Later editions include one edited by Salah ibn Muhammad Uwaydah and published by Dar al-Kutub al-Ilmiyyah in Beirut in 1418 AH .
