Al-Ahkam al-Mutarttiba ala al-Hayd wa al-Nifas wa al-Istihada (The Legal Rulings Resulting from Menstruation, Postnatal Bleeding, and Irregular Bleeding) is a contemporary treatise on Islamic jurisprudence by Salih al-Lahim, professor of fiqh at the College of Sharia at Qassim University, examining the legal rulings governing vaginal bleeding in women.
Structure and Contents
The work is organized into an introductory overview and three chapters:
- Introduction (Tamhid): Covers the definitions of menstruation, postnatal bleeding, and irregular bleeding, providing both linguistic definitions and technical definitions from various schools of jurisprudence.
- Chapter One (Rulings of Menstruation): Divided into sections addressing purity and worship (such as reciting the Quran, remembrance, touching the Mus'haf, bodily purity, entering mosques, ritual bathing, and washing upon death), prayer, fasting, spiritual retreat (i'tikaf), Hajj and 'Umrah, sexual intimacy, divorce, consensual separation (khul'), the oath of sexual abstention (ila'), the waiting period ('iddah), ascertaining non-pregnancy (istibra'), financial maintenance, ritual slaughter, and menstruation as a sign of puberty.
- Chapter Two (Rulings of Postnatal Bleeding): Discusses the legal rulings of postnatal bleeding, noting that it generally shares the rulings of menstruation regarding obligations, prohibitions, and exemptions, while treating exceptions such as establishing puberty, counting the waiting period, and oaths of abstention.
- Chapter Three (Rulings of Irregular Bleeding): Consists of three sections examining the principle that a woman experiencing istihada retains the legal status of ritually pure women, her manner of ritual purification for prayer, and the permissibility of sexual intercourse.
Publication
The work was published by Dar Ibn al-Jawzi as the 28th entry in its series of peer-reviewed academic research (Silsilat al-Buhuth al-Ilmiyyah al-Muhakkama).
