Ahkam al-Salat ala al-Janaza fi al-Masjid (The Rulings of the Funeral Prayer in the Mosque) is a legal treatise by the Hanafi jurist and hadith scholar Ibn Qutlubugha (802–879 AH / 1400–1474 CE) examining the legal status of performing funeral prayers inside mosques .
Background and Cause of Composition
Ibn Qutlubugha composed the treatise after a public misunderstanding arose regarding the Hanafi position on holding funeral prayers in mosques . Some contemporaries assumed that the practice was unobjectionable in the school after witnessing the Hanafi grand judge Sa'd al-Din al-Dayri pray over Ibrahim Ibn al-Ji'an inside al-Azhar Mosque . When Ibn Qutlubugha, who conducted such prayers in open courtyards outside the mosque, was asked about the ruling, he stated that the transmitted position of the school is prohibition and set out his evidence in this dedicated work .
Content and Legal Argument
The treatise substantiates the Hanafi stance that performing the funeral prayer inside a mosque is disliked (makruh), drawing upon foundational texts of the madhhab . Ibn Qutlubugha cites Muhammad ibn al-Hasan al-Shaybani in his recension of al-Muwatta', as well as Abu Ja'far al-Tahawi in Sharh Ma'ani al-Athar, recording that the prohibition and dislike are established from Abu Hanifa, Muhammad ibn al-Hasan, and Abu Yusuf, with a transmitted nuance from Abu Yusuf permitting it only if a mosque is designated specifically for funeral services .
In assessing the level of disapproval, Ibn Qutlubugha argued for prohibitive dislike (karaha tahrimiyya), diverging from his teacher Ibn al-Humam, who had argued that the dislike was merely discouragement (karaha tanzihiyya) .
Publication
The work has been published in modern editions, including within a collected volume of Ibn Qutlubugha's short legal treatises edited by 'Abd al-Hamid Muhammad al-Darwish and 'Abd al-'Alim Muhammad al-Darwish, as well as an independent edition edited by Abu al-Mundhir Mahmud ibn Muhammad al-Minyawi .
