Saeed Baashan (d. 1270 AH / 1854 CE) was a Hadrami Shafi'i jurist and scholar from the Daw'an valley in Hadramawt, best known for his legal commentary Bushra al-Karim .
Life and Legal Career
His full name was Sa‘id ibn Muhammad Ba‘ali Ba‘ashan al-Daw‘ani al-Ribati al-Hadrami , also recorded in manuscript records as Sa‘id ibn Muhammad ibn ‘Ali Ba‘ashan . He was associated with the town of al-Ribat in the Daw‘an region of Hadramawt .
Baashan was an authority in Shafi'i jurisprudence whose legal responsa were sought and preserved by contemporaries and students . His legal verdicts were compiled alongside those of the scholar Abdullah ibn Ahmad Basudan in a collection titled Silah al-Insan wa-Madhhab al-Itqan by their student Sa‘id ibn Muhammad ibn ‘Abd Allah Badhkuk . He died in 1270 AH (1854 CE).
Jurisprudential Method
Baashan is most celebrated for Bushra al-Karim bi-Sharh Masa'il al-Ta'lim, an explanation of Abdullah ibn Abd al-Rahman Bafadl's foundational legal manual al-Muqaddima al-Hadramiyya . Baashan originally wrote an extensive commentary on Bafadl's text before abridging it to roughly half its original size into the definitive version of Bushra al-Karim . In this commentary, he synthesized the opinions of late Shafi'i authorities, centering his analysis on adjudicating the differences between Ahmad ibn Hajar al-Haytami and Muhammad al-Ramli . He reasoned that the stances of other major late authorities—such as Zakariyya al-Ansari, al-Shihab al-Ramli, al-Khatib al-Shirbini, and Ibn Ziyad—rarely diverge from the conclusions reached by Ibn Hajar and Muhammad al-Ramli .
To streamline citation, Baashan established a system of sigla for these jurists, such as Haj for Ibn Hajar, M R for al-Ramli, S M for Ibn Qasim al-Ibbadi, ‘A Sh for al-Shabramallisi, and B J for al-Bujayrimi . In his legal methodology, he maintained that it is permissible to follow any of these authenticated positions for personal practice, legal verdicts, or judicial rulings, provided the opinion has not been widely recognized as an error, oversight, or weak ruling . Beyond this commentary, he also authored Mawahib al-Dayyan bi-Sharh Fath al-Rahman .
