Hasan Ali al-Shadhili (d. 1439 AH / 2017–2018 CE) was an Egyptian scholar of comparative Islamic jurisprudence, university professor, and author of al-Jinayat fi al-Fiqh al-Islami (Offenses in Islamic Jurisprudence).

Academic career

Al-Shadhili served as a lecturer of comparative jurisprudence at the Faculty of Sharia and Law in Cairo around 1390 AH (1970 CE). He subsequently advanced to become a full professor and head of the Department of Comparative Jurisprudence at the Faculty of Sharia and Law at Al-Azhar University. He also relocated to Saudi Arabia, where he served as a professor and head of the Department of Comparative Jurisprudence at the Higher Judicial Institute in Riyadh.

Scholarly contributions

Al-Shadhili specialized in comparative jurisprudence, addressing both classical Islamic legal doctrines across the various legal schools (madhahib) and modern statutory legislation. In his major treatise, al-Jinayat fi al-Fiqh al-Islami: Dirasah Muqaranah bayn al-Fiqh al-Islami wa al-Qanun (Offenses in Islamic Jurisprudence: A Comparative Study between Islamic Jurisprudence and Law), completed in Shawwal 1390 AH (December 1970 CE), he examined criminal offenses against human life and physical integrity, contrasting Islamic legal rulings with statutory criminal codes in Egypt and other jurisdictions.

He participated regularly in the scholarly sessions and conferences of the International Islamic Fiqh Academy, where he presented research papers and interventions on contemporary juridical issues. His contributions included studies on family planning and birth regulation (Tandhim al-Nasl aw Tahdiduh), the legal validity of manufacturing contracts (istisna'), contractual conditions and stipulations (al-shurut fi al-'uqud), and the Islamic bioethical rulings concerning medical treatment and the sanctity of the human body.
