Badr Nasir Mishra al-Subayi is a contemporary Kuwaiti researcher in comparative Islamic jurisprudence and legal theory (usul al-fiqh) .

Academic Background

Badr ibn Nasir ibn Mishra al-Subayi completed his graduate studies at Kuwait University in the College of Graduate Studies . On 1 Sha'ban 1433 AH (21 June 2012 CE), he defended his master's thesis in comparative jurisprudence and legal theory, graduating with distinction and honors . His thesis was supervised by Fahd Sa'd al-Dubays al-Rashidi and evaluated by a committee consisting of Mubarak Jaza' al-Harbi and Hamad Muhammad al-Hajiri .

Scholarly Contributions

Al-Subayi's research focuses on contemporary issues in family law and the editing of classical Hanbali legal manuscripts. In 1435 AH (2014 CE), his master's thesis was published under the title al-Masa'il al-Fiqhiyya al-Mustajidda fi al-Nikah ma Bayyan ma Akhadh bihi al-Qanun al-Kuwayti ("Contemporary Jurisprudential Issues in Marriage with Clarification of What Kuwaiti Law Has Adopted") by the Kuwaiti Ministry of Awqaf and Islamic Affairs through the journal al-Wa'y al-Islami . The study examines modern developments relating to betrothal, modern forms of marriage contracts, and premarital medical examinations from both an Islamic legal perspective and Kuwaiti statutory law .

In the field of manuscript editing, al-Subayi edited Ibn al-Mibrad's work on Hanbali legal theory, Ghayat al-Sul ila 'Ilm al-Usul ("The Ultimate Aim in Reaching the Science of Legal Theory"), which was published in 1433 AH (2012 CE) . He also prepared a critical edition and commentary on Risalat al-'Ukbari fi Usul al-Fiqh ("The Treatise of al-'Ukbari on Legal Theory") by Abu 'Ali al-Hasan ibn Shihab al-'Ukbari, published in 1438 AH (2017 CE), in which he addressed scholarly doubts regarding the treatise's attribution to its author .
