al-Hussam al-Sighnaqi (d. 714 AH / 1314 CE) was a Central Asian Hanafi jurist, legal theorist, and grammarian, best known for his extensive legal commentary al-Nihaya fi Sharh al-Hidaya and his treatise on legal theory al-Kafi Sharh Usul al-Bazdawi.
Name and Origin
His full name was Husayn ibn Ali ibn Hajjaj ibn Ali. While some biographical dictionaries recorded his given name as al-Hasan, he explicitly identified himself as Husayn in the prefaces and colophons of his writings. He bore the honorific title Husam al-Din (often shortened to al-Hussam), as well as epithets such as Husam al-Milla wa-al-Din, Nizam al-Islam wa-al-Muslimin, and Mufti al-Bashar. His geographic nisba, al-Sighnaqi, derives from Sighnaq, a historical town in Turkestan.
Education and Travels
Al-Sighnaqi pursued his early education across the major scholarly centers of Transoxiana. He studied jurisprudence and Arabic grammar in Bukhara under Hafiz al-Din al-Kabir Muhammad ibn Muhammad ibn Nasr al-Bukhari, with whom he read grammar in 676 AH. He also studied with the jurist Hafiz al-Din Abu al-Barakat al-Nasafi, and received the transmission line of al-Hidaya through his teacher Fakhr al-Din al-Maymarghi, who relayed it from Shams al-A'imma al-Kardari back to its author, Burhan al-Din al-Marghinani.
In his later years, al-Sighnaqi traveled westward into the Levant and Iraq, visiting Baghdad and arriving in Damascus in 710 AH before ultimately settling in Aleppo.
A number of prominent scholars studied under him, including Qawam al-Din al-Itqani, Jalal al-Din al-Karlani (author of al-Kifaya), and Abd Allah ibn Hajjaj al-Kashghari.
Standing
Al-Sighnaqi was widely regarded as a master of Hanafi substantive jurisprudence (furu'), legal theory (usul), grammar, and dialectics (jadal). According to Ibn Hajar al-Asqalani, he was the first scholar to author an expansive commentary on al-Marghinani's al-Hidaya, titled al-Nihaya. Later Hanafi authorities, including Akmal al-Din al-Babarti, praised the commentary for its rigorous verification and deep analytical clarity, making it a foundational reference for subsequent Hanafi commentators. In the field of legal theory, his commentary on Fakhr al-Islam al-Bazdawi's Usul, titled al-Kafi, was recognized as an essential text for resolving ambiguities in early Hanafi jurisprudence.
Death
Al-Sighnaqi died in Aleppo in the month of Rajab 714 AH (1314 CE). Other biographical notices report his death as having occurred earlier in Aleppo in 711 AH, or give the year 710 AH. A separate tradition recorded by al-Sakhawi notes a grave ascribed to him in Khwarazm near the tomb of al-Zamakhshari.
