Abu al-Fadl al-Dimashqi (d. 5th century AH / 11th century CE) was a Damascus-born Maliki jurist and legal theoretician, best known for his concise manual on legal differences, al-Furuq al-Fiqhiyya ("Legal Distinctions") .

Identity and Lineage

His full name was Abu al-Fadl Muslim ibn Ali ibn Abd Allah ibn Muhammad ibn Husayn al-Dimashqi . He was widely recognized by the epithet Ghulam Abd al-Wahhab ("the protégé of Abd al-Wahhab") on account of his prolonged companionship, devoted service, and close discipleship under the eminent Iraqi Maliki master al-Qadi Abd al-Wahhab (d. 422 AH) . The exact year of his death is unrecorded in biographical literature, though sources place his passing in the fifth century AH .

Education and Scholarly Activity

Al-Dimashqi belonged to the rationalist Iraqi branch of the Maliki school of law . Alongside al-Qadi Abd al-Wahhab, he received instruction under Abu Bakr al-Abhari (d. 375 AH) . He maintained a long association with al-Qadi Abd al-Wahhab, attending his teaching circles alongside prominent contemporaries and serving him throughout his study of jurisprudence .

Legal Distinctions and Method

Al-Dimashqi's principal contribution lies in the genre of al-furuq al-fiqhiyya (subtle legal distinctions between outwardly similar cases) . In the introduction to al-Furuq al-Fiqhiyya, he explained the motivation for compiling the text: al-Qadi Abd al-Wahhab had informed him of writing a work titled al-Jumu' wa-al-Furuq, which had been lost without any surviving copy, while other Maliki scholars had left distinctions scattered across voluminous treatises rather than collecting them independently . Al-Dimashqi organized these distinctions into a concise and accessible format to facilitate their study and memorization .

In structuring his legal comparisons, al-Dimashqi typically introduced entries with the formula "a distinction between two issues" (farq bayn mas'alatayn), presenting the two cases before expounding their underlying justifying causes ('ilal) and rulings . He frequently specified the unifying common denominator (al-jami') connecting the cases despite their differing legal outcomes . Throughout his analysis, he anchored his legal deductions in the foundational Maliki source al-Mudawwana and the opinions of Malik ibn Anas, citing his teacher al-Qadi Abd al-Wahhab repeatedly to resolve intricate points of doctrine .
